Terms of Service
1. Acceptance of Terms
By accessing or using VoiceForEternity ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and customers of VoiceForEternity, operated by No Filter Software ("we," "us," or "our").
2. Description of Service
VoiceForEternity is a voice memorial platform that allows users to record, preserve, and share audio recordings and stories of loved ones. The Service includes:
- A digital memorial page accessible via unique URL and QR code
- Audio recording tools (browser-based and phone-based)
- Optional laser-engraved stainless steel memorial plaques
- Family sharing and contribution features
- The Listening Room, a public discovery experience at listen.voiceforeternity.com
3. Eligibility
You must be at least 18 years of age to create an account or purchase products through VoiceForEternity. By using the Service, you represent and warrant that you are 18 years of age or older. If you are creating a memorial on behalf of a deceased person, you represent that you have the authority to do so.
4. Accounts
4.1 Account Creation
To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
4.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@voiceforeternity.com if you suspect unauthorized access.
4.3 Account Termination
We reserve the right to suspend or terminate your account at our discretion if you violate these Terms or engage in conduct harmful to other users or the Service.
5. Purchases and Payments
5.1 Pricing
All prices are listed in U.S. dollars. Prices are subject to change without notice. You will be charged the price displayed at the time of purchase.
5.2 One-Time Purchase Model
VoiceForEternity operates on a one-time purchase model. There are no recurring subscription fees. Your memorial and its content are preserved for the life of the platform under the terms of your purchase.
5.3 Payment Processing
Payments are processed securely through Stripe. VoiceForEternity does not store your full credit card information. By providing payment information, you authorize us to charge the applicable fees.
6. Refund Policy
6.1 Digital Products
Digital memorial products (online memorial pages, audio storage, QR access) are eligible for a full refund within 30 days of purchase, provided the memorial has not been actively used to store contributed recordings from third parties.
6.2 Physical Products — Memorial Plaques
Stage 1 — Before plaque is ordered from vendor: A full refund is available within 30 days of purchase. Contact support@voiceforeternity.com to request a refund.
Stage 2 — After plaque is ordered, before it ships: Once a plaque has been submitted to our production vendor, the plaque cost is non-refundable. If your overall purchase is within 30 days, the digital memorial portion may still be refunded at our discretion.
Stage 3 — After plaque has shipped: All sales are final once a physical plaque has shipped. No refunds will be issued.
6.3 Dispute Process
If you believe a refund is warranted under circumstances not covered above, you may submit a dispute request to support@voiceforeternity.com. Include your order number and reason for the dispute. We will review your request and respond within 3 business days. All dispute decisions are made at the sole discretion of No Filter Software and are final.
6.4 Important Notice at Checkout
By completing a purchase that includes a physical plaque, you acknowledge and agree that once your plaque enters production, the plaque cost is non-refundable, regardless of the reason for cancellation.
7. User Content
7.1 Your Content
You retain ownership of all audio recordings, text, photos, and other content ("User Content") you upload or create through the Service. By uploading User Content, you grant No Filter Software a non-exclusive, worldwide, royalty-free license to store, process, and display your content solely for the purpose of providing the Service.
7.2 Content Responsibility
You are solely responsible for your User Content. You represent and warrant that you own or have the necessary rights to upload the content, your content does not violate any third-party rights including copyright, privacy, or publicity rights, and your content does not contain anything unlawful, harmful, defamatory, or obscene.
7.3 Content We May Remove
We reserve the right to remove any User Content that violates these Terms or that we determine, in our sole discretion, is inappropriate, harmful, or unlawful.
8. The Listening Room
The Listening Room at listen.voiceforeternity.com is a public discovery experience. By setting your memorial to "public," you consent to your memorial's content (name, years, a recording excerpt, and quote) being featured in The Listening Room. You may remove your memorial from public discovery at any time by changing your memorial's visibility setting to "private" in your dashboard. Use of The Listening Room is subject to its own Terms of Use, available at listen.voiceforeternity.com/terms.
9. Phone Recording Feature
VoiceForEternity offers an inbound phone recording service via a shared toll-free number. By using this feature:
- You agree that calls may be recorded for the purpose of creating memorial content
- You are responsible for informing any callers that their voice will be recorded and preserved
- You are responsible for obtaining consent from contributors before sharing your Contributor PIN
- Owner recordings are automatically approved
- Contributor recordings are held for your review
10. Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose
- Upload content that infringes on any third party's intellectual property rights
- Upload content depicting or promoting violence, abuse, or illegal activity
- Attempt to gain unauthorized access to any part of the Service
- Scrape, crawl, or use automated tools to access or harvest data from the Service
- Reverse engineer, decompile, or attempt to extract the source code of the Service
- Impersonate any person or entity
- Use the Service to harass, threaten, or harm any individual
11. Intellectual Property
All content, design, code, logos, and materials on VoiceForEternity (excluding User Content) are the property of No Filter Software and are protected by applicable intellectual property laws. You may not copy, reproduce, modify, or distribute any part of the Service without our express written permission.
12. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
13. Service Reliability and Our Commitment
We are committed to keeping VoiceForEternity secure, reliable, and available. We use industry-standard security practices, reputable infrastructure providers, and take the protection of your memories seriously. That said, no online service can guarantee 100% uptime or that issues beyond our control — such as internet outages, third-party service disruptions, or unforeseen technical failures — will never occur. We ask for your understanding that while we will always do our best to protect and preserve your content, we cannot be held legally liable for interruptions or losses caused by circumstances outside our reasonable control. If you ever experience an issue, please contact us at support@voiceforeternity.com and we will make it right.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NO FILTER SOFTWARE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
15. Indemnification
You agree to indemnify, defend, and hold harmless No Filter Software and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.
16. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Fresno County, California.
17. Changes to These Terms
We reserve the right to update these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
